REGULATIONS OF THE ONLINE SERVICE

  1. Definitions used in these regulations mean:

  1. Regulations these regulations of the Online Service

  2. Seller – APRONEE Dziedzic, Kopaczel Limited Partnership, based in Konstantynów Łódzki (postal code: 95-050) at ul. Łódzka 42, entered into the register of entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Economic Division of the National Court Register under KRS number: 0001136401, NIP: 7312089172, REGON: 540085047, tel. +48 603 123 274, e-mail: sklep@apronee.pl and shop@apronee.com

  3. Customer a natural person (an adult person with full legal capacity), a legal person, or an organizational unit without legal personality, granted legal capacity by statute,

  4. Product goods offered by the Seller in the Online Service,

  5. Online Service the online service available at the web addresses www.apronee.pl and www.apronee.com along with its subdomains

  6. Online Form a form available in the Online Service enabling registration

  7. Order Form a form available in the Online Service enabling the placement of an order

  8. Agreement a sales contract in the meaning of the Act of April 23, 1964, the Civil Code, regarding the Product, concluded between the Customer and the Seller using remote communication means

  9. Price list the price list of Products available on the Online Service page

  10. Order – the Customer's declaration of intent made using the Online Service (Order Form), directly aimed at concluding the Agreement

  11. Delivery area the territory of the Republic of Poland

  12. External entity companies cooperating with the Seller in order to fulfill the conditions of the Agreement concluded between the Seller and the Customer. These companies process personal data only for purposes arising from the Agreement.

  13. Business day a day falling from Monday to Friday, other than a statutory holiday.

  1. General Provisions

  1. The owner of the online service at www.apronee.pl and www.apronee.com (hereinafter referred to as "Seller") is APRONEE Dziedzic, Kopaczel Limited Partnership, based in Konstantynów Łódzki (postal code: 95-050) at ul. Łódzka 42, entered into the register of entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Economic Division of the National Court Register under KRS number: 0001136401, NIP: 7312089172, REGON: 540085047, tel. +48 603 123 274, e-mail: sklep@apronee.pl and shop@apronee.com

  1. The Regulations of the Online Service specify the types and scope of electronic services provided, the rules for concluding contracts using the Online Service and e-mail, as well as by phone, the rules for performing these contracts, the rights and obligations of the Customer and the Seller, as well as issues of withdrawal from the contract and complaints procedures.

  2. The Seller undertakes to sell Products to the Customer within the scope and under the conditions specified in the Regulations.

  3. The Seller informs that there may be a necessity to conduct maintenance work on telephone systems, during which there may be temporary difficulties in accessing electronic services provided through the online service. The Seller will make every effort to keep these difficulties to a minimum and for the shortest time possible.

  4. Due to the use of the Internet to provide services, the Seller informs about possible risks related to the interference of third parties in electronic data transmissions between the Seller and the Customer.

  5. The Seller is an entrepreneur within the meaning of the Act of March 6, 2018, the Entrepreneurs Law.

  6. The Seller is both the party offering goods and services within the Online Service and the provider of the online trading platform (Online Service); therefore, in the further part of the Regulations, obligations related to the contract concluded with the Customer are not separated between a third party offering goods and services within the Online Service and the provider of the online trading platform (Online Service).

  1. Technical Requirements for Using the Online Service

  1. Using the Online Service involves the following technical requirements on the part of the Customer:

  1. - Computer or mobile device with internet access

  2. - Access to an email account

  3. - Internet browser: Internet Explorer, Firefox, Chrome, Opera, Safari

  4. - Enabling cookies and JavaScript in the internet browser

  1. Ordering Products

  1. In order to use the services offered within the Online Service, registration must be completed. Registration takes place by correctly filling out and sending the Registration Form to the Seller. During registration, the Customer provides an email address for contact with the Seller and sets a password that allows access to the Customer's account. In the case of natural persons, the Customer confirms their legal age and full legal capacity, as well as their status as an entrepreneur. The Customer may only have one account and may only use their own account. The data provided by the Customer must be true and up to date. The Customer is obliged to update their data each time a change occurs, using the Customer Panel after logging into www.apronee.pl or www.apronee.com, or by sending data updates to the email address sklep@apronee.pl and shop@apronee.com .The Customer bears the responsibility for any negative consequences of failure to update data.

  1. The Customer is obliged to protect the confidentiality of information allowing access to their account in the Online Service, in particular by not disclosing this information to third parties. The Customer is solely responsible for damages caused by disclosing their login information to third parties or leaving their account logged in to the Online Service while not using it.

  2. The Customer agrees to use the Online Service in accordance with applicable law and social coexistence principles and to comply with these Regulations.

  3. The Seller allows placing orders through the Online Service (Order Form). Orders can be placed through the Online Service 7 days a week, 24 hours a day.

  4. The order process through the online service begins when the Customer starts filling out the Order Form located in the Ordertab. The Customer selects:

  • the type of Products
  • the quantity of Products
  • and provides:
  • necessary data for order fulfillment, i.e., personal details and delivery address
  1. The Seller is not liable for damages arising in the event of the Customer providing incomplete or incorrect, untruthful information.

  2. After making the selections, the Customer confirms they have read the content of the Regulations and gives consent for their personal data to be processed and for the conclusion of the Agreement by confirming the order and committing to pay the amount indicated in the order.

  3. The current offer is available at www.apronee.pl or www.apronee.com.

  4. If the Customer wishes to receive an invoice, they must notify the Seller of this at the time of placing the order, by informing the Seller by email or phone or by selecting that option when placing an order through the Online Service.

  5. In all cases of informing about a price reduction for goods or services when placing an order, along with the information about the reduced price, there will also be information about the lowest price of that good or service that was in effect during the 30 days prior to the reduction. If the given good or service has been offered for sale for less than 30 days, when placing an order, alongside the information about the reduced price, there will also be information about the lowest price of that good or service that was in effect from the start of offering that good or service for sale to the day of the price reduction.

  1. Order Fulfillment

The methods, costs, and delivery times of goods as well as payment processing are specified each time when placing an order. The ordered and paid goods are shipped within 2-3 working days. In the event of an out-of-stock situation, shipping will occur within 10 working days.

  1. Payment Methods

  1. The following payment methods are available:

  • online transfer online through the online payment provider
  • directly to the Seller's bank account at PKO BP no. 45 1020 3408 0000 4502 0586 6662
  • Payment for the ordered Product must be made in full within 3 days from the confirmation date of the order. Failure to pay within the specified timeframe results in order cancellation.
  1. In the case of traditional bank transfers, the Customer is obliged to provide the Seller with proof of the transfer within 3 days from the order date.

  2. The date of payment is considered the date of crediting the payment to the Seller's account.

  1. Right to Withdraw from the Agreement

  1. Customers have the right to withdraw from the agreement without giving a reason within 14 days from the receipt of the goods.

  2. The withdrawal period is considered observed if the Customer sends the returned item back to the Seller without delay, and in any case no later than 14 days from the day the Customer informed the Seller of the withdrawal.

  3. To exercise the right to withdraw from the agreement, the Customer must submit an unambiguous declaration of withdrawal from the agreement via one of the following channels:

  • electronic return form available on www.apronee.pl or www.apronee.com
  • by sending an email to: sklep@apronee.pl or shop@apronee.com
  • in writing, by sending the withdrawal to: Apronee Dziedzic, Kopaczel Limited Partnership, 95-050 Konstantynów Łódzki, ul. Łódzka 42
  1. The withdrawal period is considered observed if the Customer sends the information regarding the exercise of their right to withdraw from the agreement before the expiry of the withdrawal period. After such a withdrawal notification, the Customer has 14 days to return the Goods to the Online Store.

  2. The Customer may use the model withdrawal form, but it is not mandatory. A sample model withdrawal form is included in Annex No. 2 to the Act of May 30, 2014, on consumer rights and is additionally available on the website at www.apronee.pl or www.apronee.com.

  3. In the case of withdrawal from the agreement, the Seller will refund all payments received from the Customer, including the costs of delivering the item (except for additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller) without delay, and in any case no later than 14 days from the day of receiving the Customer's declaration of withdrawal from the agreement.

  4. The Store will refund the payment using the same payment method that was used by the Customer in the transaction. In the case of "Cash on Delivery" payment, the refund will be made to the bank account number provided in the return form.

  5. The Seller may withhold the refund of payments received from the Customer until the returns of the goods are received or proof of shipment is provided by the Customer, depending on which event occurs first.

  6. In the case of the return of part of the order, the Customer bears the direct costs of returning the item. Furthermore, if the Customer chose a method of delivering the Goods other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to refund the Consumer the additional costs incurred.

  7. The Customer is responsible for the decrease in value of the item resulting from using it in a manner other than was necessary to ascertain the nature, characteristics, and functioning of the item.

  8. The right to withdraw from the agreement does not apply if the subject matter of the service is an item delivered in a sealed package that cannot be returned for health protection or hygiene reasons once opened if the package was opened after delivery.

  1. Blocking or Deleting an Account

  1. The Seller may block the Customer's account in the Online Service if the Customer, despite warnings, violates the provisions of the Regulations.

  1. Blocking by the Seller of the Customer's account in the Online Service will result in the temporary loss of the ability to use the services. However, blocking the Customer's account in the Online Service will not interrupt the execution of ongoing orders.

  2. The Customer may at any time request the deletion of their account in the Online Service via email. The Seller commits to delete the account within two business days from the registration of the request.

  3. The Seller may also delete the Customer's account from the online service if the Customer:

  • despite warnings, grossly violates the Regulations;
  • the Customer has not used the Online Service for the last 3 years, with the condition that there is no pending order at that moment.
  1. Deleting the Customer's account from the Online Service results in the irreversible loss of all information collected there by the Customer.

  1. Complaints Procedure

  1. Complaints related to the operation of the Online Service and the provision of Customer Services can be submitted: via email to: sklep@apronee.pl or shop@apronee.com

  1. Complaints related to the execution of the contract must be reported by the Customer within 7 days from the date of receiving the delivery. Exceptions are complaints regarding undelivered deliveries, in which case the complaint should be submitted within 3 days. Notifications made by the Customer after the aforementioned deadline will not be considered.

  2. A complaint should include the Customer's first name, last name, and address, phone number, order number it pertains to, and the delivery date if the complaint concerns a specific delivery, as well as a brief description of the incident that caused the complaint, optionally including photographic documentation.

  3. The Seller will consider the complaint within 14 calendar days from the date of receipt of the complaint.

  4. In matters not regulated above, the provisions of Chapter 5a of the Act of May 30, 2014, on consumer rights apply in the case of a Customer who is a consumer; in the case of other persons, the provisions of Book Three, Title XI, Section II of the Act of April 23, 1964, the Civil Code apply.

  1. Personal Data Protection

  1. The administrator of personal data is the Seller.

  1. Detailed information regarding the processing of personal data, including the purposes, scope, basis, and principles of their processing, is indicated in the Privacy Policy available on the website of the online service.

  1. Copyright

  1. The Online Service and its individual elements are protected under the Act of February 4, 1994, on copyright and related rights.

  1. The Customer is not entitled to copy the Online Service, except in cases where such action is permitted by mandatory provisions.

  1. Final Provisions

  1. The Seller is entitled to make changes to the Regulations, including changes related to: changes in the law; changes in delivery or payment methods; adding new electronic services to the extent that these changes affect the implementation of the provisions of these Regulations.

  1. Changes to the Regulations are binding for the Customer if they have been properly informed about the changes made and have not terminated the agreement within 14 calendar days from the date of notification.

  2. In matters not regulated by these regulations, generally applicable provisions of Polish law shall apply, in particular: the Act of April 23, 1964, the Civil Code; the Act of July 18, 2002, on providing services by electronic means; the Act of May 30, 2014, on consumer rights.
